2011 racial abuse incident

After a 1–1 draw against Manchester United on 15 October 2011, Suárez was accused of racially abusing Patrice Evra and the English Football Association opened up an investigation into the incident. Suárez wrote on his Twitter and Facebook pages that he was upset by the accusation and denied the claims.

On 16 November, the FA announced it would charge Suárez with "abusive and/or insulting words and/or behaviour contrary to FA rules", including "a reference to the ethnic origin and/or colour and/or race of Patrice Evra." Liverpool F.C. released a statement announcing Suárez would plead innocent, adding that they would "remain fully supportive" of him.

On 20 December, the FA concluded a seven-day hearing, handing Suárez an eight-match ban and a £40,000 fine for racially abusing Evra. The FA's ruling was met with approval from Manchester United's manager, Sir Alex Ferguson,...

Following the FA's ruling, Liverpool issued a statement which claimed the club was "very surprised and disappointed" at the ban and pointed out that Evra had told the FA, "I don't think that Luis Suarez is racist", and cited Suarez's mixed race family background, as well as his involvement with multicultural projects. However, Liverpool were criticized their attacking of the moral integrity of the FA, as they claimed during their statement that "the FA were determined to bring charges… even before interviewing [Suarez] at the beginning of November", despite the fact that the panel overseeing the investigation were independent of the FA.

In the days following the announcement of the FA's decision, Suarez received support from the manager and many players of the Uruguay national team, calling the ban "a senseless fiasco" and claiming that "Luis [Suárez] is [a] victim." Former Liverpool player John Barnes claimed that Suárez had been the victim of a witch hunt, although he also admitted that "racism has to be zero tolerance".

To demonstrate support for Suarez, his team-mates and manager wore a T-shirt bearing Suarez's name and image before a match against Wigan. The T-shirts provoked criticism that the gesture conflicted with football's anti-racism campaign Kick It Out, confusing its zero tolerance message. Former footballer Olivier Bernard commented that "I don’t mind them giving support to Mr Suarez, but I just think it’s wrong to wear the T-shirt because that means they have allowed racist language", while fellow former footballer Paul McGrath said that "it would have been much better for Liverpool if they’d have worn anti-racism shirts".

On 31 December 2011, the FA released the contents of their findings. In a 115-page report, the FA said that Suárez "damaged the image of English football around the world". The FA, while finding Evra to be a credible witness, declared that Suárez's evidence was unreliable and inconsistent with the video footage. According to Evra's testimony, Suarez said in Spanish that he had earlier kicked Evra "because you are black", said "I don't speak to blacks" and used the word "negro" five times in total as they argued. Suárez had claimed that his use of the word 'negro' to address Evra was conciliatory and friendly, but the FA rejected this claim as being "unsustainable and simply incredible given that the players were engaged in an acrimonious argument." As the conversation between Suárez and Evra took place in Spanish, linguistic experts were called in to help the panel with the meaning of the phrases. The panel concluded that "Suarez's use of the term [negro] was not intended as an attempt at conciliation or to establish rapport; neither was it meant in a conciliatory and friendly way." Suárez was also warned that two similar offences in the future could lead to "a permanent suspension".

Liverpool later made the decision not to appeal Suarez's eight match ban, releasing a statement voicing their support "to stamp out racism in every form, inside and outside the sport", adding that it was "for this reason that [Liverpool] will not appeal the eight-game suspension of Luis Suarez". However, Liverpool continued to maintain their belief in both Suarez's innocence and a "strongly held conviction" that the Football Association and the panel it selected constructed a highly subjective case...based on an accusation that was ultimately unsubstantiated".

My conclusion is that Suarez is guilty as charged. The rule is worded carefully to frame the behaviour, not the intention nor the conscious/sub-conscious beliefs of the player.

The message is clear ... if you do not want to be branded a racist in the UK... avoid those behaviours that are commonly understood to be racist in the UK. Being non-white is no defence.

Speaking of black and white, invariably finding there's grey in this .. and here's something that takes the issue to a more fuzzy level .. Penalising a football club for the behavior of the crowd at their games ...

Italian giants Juventus have been fined once again for racist chanting by their fans during Saturday's 2-1 victory against Udinese in Serie A.

Colombian wing-back Pablo Armero and Cape Verde-born Swiss midfielder Gelson Fernandes were victims of racist abuse throughout the game.

The Turin club have been given a €10,000 (£8,400) fine for their fans' conduct. This is the same amount they were docked in October over racist chanting during their win at Inter Milan.

The Old Lady have a poor record when it comes to racism, having regularly abused Manchester City striker Mario Balotelli - an Italian of Ghanaian origin – during the player's days at Inter.

In 2008-09 Juventus had to play a match behind closed doors after their fans were found guilty of racist chanting.

*thinks: this seems more like a topic for the philosophy/ethics forum .. it's interesting that these things overlap :)
